The basic legal acts that govern business activity of EUROPOL GAZ S.A. are:
- The Act on Energy Law dated April 10,1997 (Dz.U. of 2012, item 1059) - in terms of the license for transmission of gas fuels and the agreement on entrusting the tasks of the transmission system operator;
- The Act dated April 27, 2001 – the Environmental Protection Law – for the rules for determination of environmental protection and waste management policy,
- The Act dated December 21, 2000 on the Office of Technical Inspection – for assurance of operational safety for technical equipment,
- The Act dated July 7, 1994 – the Construction Law.
Moreover, the technical area of the Company’s functioning is subject to provisions of the EU’s laws, in particular the Directive No. 2009/73/EC of the European Parliament and of the Council of 13 July 2009 concerning common rules for the internal market in natural gas and repealing Directive 2003/55/EC (the ISO model).
On August 29, 2022 the President of the Energy Regulatory Office issued a decision that approved the wording of the next contract commissioning the duties of the transmission system operator to the GAZ-SYSTEM SA on the gas pipeline owned by the Company.
The decision of the President of the Energy Regulatory Office defines, inter alia, the following:
- The area of performing the business operations by the operator
- The rules for fulfilment of obligations by the parties
- Assets of the Company necessary for performing the operator’s duties by the OGP GAZ-SYSTEM SA including its use and rules for use of the assets
- Rules for calculation of the Company’s remuneration for use of its assets by the operator
- Rules for liability of the parties for either non-performance or misperformance of obligations arising from the contract including the contractual penalties.
The contract, approved by a decision of the regulatory body, was made effective on January 1, 2023 and it will remain in force until December 6, 2068.
